Personal Data Protection Notice of Netstar Advanced Systems Sdn Bhd

and/or Netstar Solutions Sdn Bhd pursuant to the Personal Data Protection Act 2010

1. Protection of Personal Data

This Personal Data Protection Notice (“Notice”) applies whenever Netstar Advanced Systems Sdn Bhd and/or Netstar Solutions Sdn Bhd (“Company”) collect and process your personal data.

The Company will collect and process your personal information (“Personal Data”) in accordance with the Personal Data Protection Act 2010, other related legislation, and the Company’s own internal policy.

The Company collects your Personal Data from:

a. you;

b. telematics device installed in your vehicle purchased from UMW Toyota Motors Sdn. Bhd. (“UMW Toyota”);

c. Netstar Road Assist App (“APP”);

d. UMW Toyota, including from UMW Toyota’s mobile applications;

e. operators of registers or databases available to the automotive / insurance industry;

f. government departments, agencies or authorities;

g. any party who has, does or will provide products or services to you and whom you have granted consent for him to disclose your personal data to us;

h. insurance intermediaries, reinsurers, third party administrators and/or service providers;

i. our commercial partners; and/or

j. Determining your location - Since the Towing Services deal with location, so to book a tow truck, Car owner (on UMW Toyota’s mobile application) need to know your location and hence Whenever you open and use/interact with our apps on your mobile device, we use the location information from your mobile device (e.g., latitude and longitude) to show your location to car owner mobile app (so he/she can book the nearest truck and can trace the location ). This information will not be shared with anyone else.

k. Background location (important): You also have to turn on "background location', this will tell us about your device's location even if you are not directly interacting with the application, this will only be used to show your location to the Car Owner App (on UMW Toyota’s mobile application) and will not be shared with anyone else

The Company also collects and processes your sensitive Personal Data. By signifying your consent, you give the Company your explicit consent to process your sensitive Personal Data such as your mental or physical health and condition, beliefs and the commission or alleged commission by you of any offence for the purposes described in this Notice or as required by law.

2. Processing of Personal Data

The Personal Data that we collect and process may include but is not limited to the following:

a. your identity (including your name, date of birth, age, National Registration Identification Card / passport details, gender and photograph);

b. your contact information (including your telephone numbers, e-mail and mailing addresses);

c. your demographic information (including your zip / postal code, region, hometown);

d. information collected pursuant to your use of UMW Toyota’s mobile application (including location data, your interaction with UMW Toyota’s mobile application (such as system log));

e. your vehicle’s information (including number plate and vehicle model);

f. telematics data such as your vehicle's geographical position and your vehicle's movements (including date, time, location, speed, vehicle’s status and diagnostics and driving behaviour such as how smoothly you drive from engine on to off);

g. your family’s information (including name, National Registration Identification Card / passport details, address, telephone number, emails and other contact details); and/or

h. any other Personal Data that is required for purposes provided herein.

i. This app also collects the location data in the background to keep the car owner updated.

3. Failure to supply information

You may choose whether or not to provide your Personal Data to the Company. If you choose not to do so, the Company may be unable to provide you with the services and/or products requested or otherwise. The Company is not liable for damages for services not rendered and/or products not delivered. Hence, it is obligatory for you to provide the Company with your Personal Data for services and/or products provided by the Company.

4. Purpose of collecting and processing your Personal Data

Your Personal Data will be collected and processed by the Company for the following purposes:

a. To better understand vehicle status and diagnostics for vehicle performance monitoring and servicing;

b. To better provide our 24-hour call centre the ability to provide emergency services such as accident assist and stolen vehicle recovery;

c. To assess your driving quality and to identify unsafe driving behaviour such as speeding, harsh braking, cornering and acceleration;

d. To facilitate the offering and provision of other services and/or products such as insurance;

e. To pool risks profiles for potential insurers for the purpose of offering and/or providing and/or recommending any insurance products;

f. For detection and prevention of criminal activity or fraud;

g. To manage and service the Company’s relationship with you and to provide you with better customer service including to respond to your emails, questions, comments, requests and complaints;

h. To conduct marketing and promotional activities;

i. To facilitate the Company’s internal administration such as auditing and maintaining database records;

j. To facilitate the Company’s business continuity management and procedures;

k. To perform internal operations necessary to provide our services and/or products, including to troubleshoot software bugs and operational problems;

l. For research, testing, statistical studies and/or data analysis;

m. For product development and to improve our services and/or products;

n. To investigate or address claims or disputes relating to use of our services and/or products; and/or

o. For all other purposes that is incidental, ancillary and/or in furtherance to the above.

5. Disclosure of Your Personal Data

The Company may share your Personal Data with the following parties (including those within and outside Malaysia):

a. The Company’s group of companies, and associated, affiliated and related companies;

b. Third party service providers and any other contractors or sub-contractors appointed by the Company as required or as the Company may determine to be necessary or appropriate;

c. Medical professionals;

d. The police;

e. Government and/or regulatory authorities;

f. Tow truck service providers;

g. Insurers, insurance agency, underwriters, reinsurers;

h. Call centres to whom the Company outsources certain business operations;

i. Commercial partners of the Company;

j. Operators of registers or databases available to the automotive and insurance industry;

k. Professional service providers working for or on behalf of the Company;

l. Persons conducting actuarial or research studies;

m. Data analytics providers;

n. Consultants;

o. External data collectors;

p. External debt collector;

q. Investigators;

r. Advertisers and/or marketing partners; and/atau

s. Any person during or in connection with any merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or a portion of our business by or into another company (if any).

6. Your right of access to your Personal Data

You have the right to request in writing, access to and correction of your Personal Data held by the Company. You may make enquiries or complaints in respect of your Personal Data by contacting our customer service department through the Company’s phone number: 03-78596958 or email: cs@netstar.asia. You may also request in writing for the Company to cease processing your Personal Data including for marketing purposes.

7. Information About Another Person

When you give the Company information about another person, you confirm that they have appointed you to act for them, and have consented to the Company processing their personal data in accordance with this Notice.

The Company reserves the right to update and amend this Notice from time to time. The Company will notify you of any amendments to the Notice via announcement on the Company’s website or via other means we deemed appropriate. If the Company amends this Notice, all Personal Data will be collected and processed by the Company in accordance with the amended Notice.

In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.

1. Perlindungan Data Peribadi

Notis Perlindungan Data Peribadi (“Notis”) ini terpakai apabila Netstar Advanced Systems Sdn Bhd dan/atau Netstar Solutions Sdn Bhd (“Syarikat”) mengumpul dan memproses data peribadi anda.

Syarikat akan mengumpul dan memproses maklumat peribadi (“Data Peribadi”) selaras dengan Akta Perlindungan Data Peribadi 2010, undang-undang yang berkaitan, dan polisi dalaman Syarikat.

Syarikat mengumpul Data Peribadi anda daripada:

a. anda;

b. alat telematik (telematics device) yang dipasang di kereta anda yang dibeli daripada UMW Toyota Motors Sdn. Bhd. (“UMW Toyota”);

c. UMW Toyota, termasuk daripada aplikasi mudah alih UMW Toyota;

d. pengendali pangkalan data yang tersedia untuk industri automotif / insurans;

e. jabatan, agensi atau pihak berkuasa kerajaan;

f. mana-mana pihak yang telah atau akan memberi produk atau perkhidmatan kepada anda dan yang anda telah memberi persetujuan kepadanya untuk menzahir Data Peribadi kepada kami;

g. peranta insurans (insurance intermediaries), penanggung insurans semula (reinsurance), pentadbir pihak ketiga dan/atau penyedia perkhidmatan;

h. rakan kongsi perniagaan kami; dan/atau

i. orang atau organisasi yang berkenaan di mana maklumat yang dikumpul adalah penting untuk tujuan yang dinyatakan di sini.

Syarikat juga akan mengumpul dan memproses Data Peribadi sensitif anda. Dengan menandakan persetujuan anda, anda memberikan kami persetujuan nyata anda untuk kami memproses Data Peribadi sensitif anda seperti maklumat tentang kesihatan atau keadaan fizikal atau mental, kepercayaan agama dan pelakuan apa-apa kesalahan (jika ada), bagi tujuan-tujuan yang dinyatakan di Notis ini atau seperti yang diperlukan oleh undang-undang.

2. Pemprosesan Data Peribadi

Data Peribadi yang kami kumpul dan proses mungkin termasuk tetapi tidak terhad kepada yang berikut:

a. identiti anda (termasuk nama, tarikh lahir, umur, nombor kad pengenalan / maklumat passport, jantina atau gambar anda);

b. maklumat perhubungan anda (termasuk nombor telefon, e-mel dan alamat pos);

c. maklumat demografi anda (termasuk kod pos, wilayah, atau kampung anda);

d. maklumat kewangan anda;

e. maklumat yang dikumpul berdasarkan penggunaan aplikasi mudah alih UMW Toyota oleh anda (termasuk data lokasi, data berkenaan interaksi anda dengan aplikasi mudah alih UMW Toyota (seperti log sistem));

f. maklumat kereta anda (termasuk plat nombor dan model kenderaan);

g. data telematik, seperti kedudukan geografi kenderaan anda dan pergerakan kenderaan anda (termasuk tarikh, masa, lokasi, kelajuan, status dan diagnostik kenderaan dan tabiat memandu (driving behaviour) seperti kelancaran pemanduan anda bermula dari enjin hidup ke enjin mati);

h. maklumat keluarga anda (termasuk nama, nombor kad pengenalan / maklumat passport, alamat, nombor telefon, e-mel dan maklumat perhubungan lain); dan/atau

i. apa-apa Data Peribadi yang diperlukan untuk tujuan-tujuan yang dinyatakan di sini.

3. Kegagalan dalam memberi maklumat

Anda boleh memilih sama ada anda hendak memberi Data Peribadi anda kepada Syarikat. Sekiranya anda memilih untuk tidak memberi Data Peribadi anda kepada Syarikat, Syarikat mungkin tidak dapat memberikan perkhidmatan dan/atau produk yang anda meminta atau sebaliknya. Syarikat tidak akan bertanggungjawab terhadap sebarang kerugian akibat kegagalan pemberian perkhidmatan dan/atau penghantaran produk. Oleh itu, ia adalahlah wajib bagi anda untuk memberi Data Peribadi anda kepada Syarikat supaya Syarikat dapat memberi perkhidmatan dan/atau produk kepada anda.

4. Tujuan pengumpulan dan pemprosesan Data Peribadi anda

Data Peribadi anda akan dikumpul dan diproses oleh Syarikat untuk tujuan-tujuan yang berikut:

a. Untuk lebih memahami status dan diagnostik kenderaan bagi pemantauan prestasi dan servis kenderaan;

b. Untuk mempersiapkan pusat panggilan 24 jam kami dengan lebih baik bagi menyediakan perkhidmatan kecemasan seperti bantuan kemalangan dan menemui semula kenderaan yang dicuri;

c. Untuk menilai kualiti pemanduan anda dan untuk mengenal pasti tabiat memandu yang tidak selamat seperti memandu melebihi had laju, brek keras, menikung (cornering) dan memecut;

d. Untuk memudahkan penawaran dan penyediaan perkhidmatan dan/atau produk lain seperti insurans;

e. Untuk mengumpulkan profil risiko untuk syarikat insurans bagi tujuan menawarkan dan/atau menyediakan dan/atau mengesyorkan sebarang produk insurans;

f. Untuk pengesanan dan pencegahan aktiviti jenayah atau penipuan;

g. Untuk mengurus dan melayani hubungan antara Syarikat dengan anda dan untuk memberi anda perkhidmatan pelanggan yang lebih baik, termasuk untuk menjawab e-mel, pertanyaan, komen, permintaan dan aduan anda;

h. Untuk menjalankan aktiviti pemasaran dan promosi;

i. Untuk memudahkan pentadbiran dalaman Syarikat seperti mengaudit dan menyelenggara rekod pangkalan data;

j. Untuk memudahkan pengurusan kesinambungan perniagaan (business continuity management) dan prosedur Syarikat;

k. Untuk menjalankan operasi dalaman yang diperlukan bagi menyediakan perkhidmatan dan/atau produk kami, termasuk untuk menyelesaikan masalah perisian (troubleshoot software bugs) dan masalah operasi;

l. Untuk penyelidikan, pengujian, kajian statistik dan/atau analisis data;

m. Untuk pengembangan produk dan untuk meningkatkan perkhidmatan dan/atau produk kami;

n. Untuk menyiasat atau menangani tuntutan atau pertikaian yang berkaitan dengan penggunaan perkhidmatan dan/atau produk kami; dan/atau

o. Untuk semua tujuan lain yang berkaitan, sampingan dan/atau yang berkaitan dengan perkara di atas

5. Penzahiran Data Peribadi anda

Syarikat mungkin akan berkongsi Data Peribadi anda dengan mana-mana pihak yang berikut (termasuk di dalam atau di luar Malaysia):

a. Kumpulan syarikat kami, dan syarikat bersekutu, gabungan dan berkaitan kami;

b. Penyedia perkhidmatan pihak ketiga dan mana-mana kontraktor atau subkontraktor lain yang dilantik oleh Syarikat mengikut keperluan atau sebagaimana yang ditentukan oleh Syarikat sekiranya dirasa perlu atau sesuai;

c. Professional perubatan;

d. Polis;

e. Kerajaan dan/atau pihak berkuasa pengawalseliaan;

f. Penyedia perkhidmatan trak tunda;

g. Penanggung insurans, agensi insurans, penaja jamin, penanggung insurans semula;

h. Pusat panggilan yang mengusahakan operasi perniagaan tertentu bagi pihak Syarikat;

i. Rakan kongsi perniagaan Syarikat;

j. Pengendali pangkalan data yang tersedia untuk industri automotif / insurans;

k. Penyedia perkhidmatan profesional yang bekerja untuk atau bagi pihak Syarikat;

l. Orang yang menjalankan kajian aktuari atau penyelidikan;

m. Penyedia analisis data;

n. Perunding;

o. Pengumpul data luar (External data collectors);

p. Pemungut hutang luar (External debt collector);

q. Penyiasat;

r. Rakan kongsi pengiklan dan/atau pemasaran; dan/atau

s. Mana-mana orang, apabila berlakunya penggabungan, penjualan aset syarikat, penyatuan atau penyusunan semula, pembiayaan atau pemerolehan semua atau sebahagian perniagaan kami oleh atau ke syarikat lain (sekiranya ada).

6. Hak anda untuk mengakses Data Peribadi anda

Anda berhak meminta secara bertulis, akses ke dan pembetulan terhadap Data Peribadi anda yang dipegang oleh Syarikat. Anda boleh membuat pertanyaan atau aduan berkenaan dengan Data Peribadi anda dengan menghubungi perkhidmatan pelanggan kami melalui nombor telefon Syarikat: 03-78596958 atau emel: cs@netstar.asia. Anda mungkin juga boleh meminta secara bertulis agar Syarikat berhenti memproses Data Peribadi anda termasuk untuk tujuan pemasaran.

7. Maklumat mengenai orang lain

Apabila anda memberikan maklumat mengenai orang lain kepada Syarikat, anda mengesahkan bahawa mereka telah melantik anda untuk bertindak bagi pihak mereka, dan telah memberikan persetujuan tentang pemprosesan Data Peribadi mereka oleh Syarikat selaras dengan Notis ini.

Syarikat berhak untuk mengemas kini dan mengubah Notis ini dari semasa ke semasa. Syarikat hanya akan memaklum anda mengenai sebarang perubahan pada Notis ini melalui pengumuman di laman web Syarikat atau melalui cara lain yang Syarikat berasa sesuai. Sekiranya Syarikat mengubah Notis ini, semua Data Peribadi akan dikumpul dan diproses oleh Syarikat berdasarkan Notis yang telah digubah tersebut.

Sekiranya terdapat pencanggahan di antara versi Bahasa Inggeris dan versi Bahasa Malaysia notis ini, versi Bahasa Inggeris akan diguna pakai.

I agree and consent to receive information on marketing, promotional and new or value-added services from the Company and/or from third parties mentioned in the personal data protection notice of the Company and I consent for the Company to share my personal data with such companies for such purposes.
